This list doesn’t pretend to be complete, we haven’t listed them all because quite honestly there are too many of live recordings in circulation among the fans of the band -- these are just the most popular, storical ones. Today the market is full of digital bootlegs of last tours: "13 Reunion" and "The End", we don't list those. Our aim is not a bootleg promotion or approval of the informal market. We only want to show the extreme interest of fans for the band. This is a reason because these unofficial recordings exist and have a great success -- desire of the fans to immortalize each unique performance, each unrepeatable guitar improvisation of the Master. We deliberately did not include demos and studio sessions, but only live recordings.
A bootleg recording is an audio or video recording of a performance that was not officially released by the artist or under other legal authority. The process of making and distributing such recordings is known as bootlegging and a far more complex subject than many would believe.
Whilst the majority of artist seek to protect their music, an increasing number have decided to allow and even encourage live audience recording. However both they and their fans generally consider selling these recordings as illegitimate bootlegging and believe they should be used only for their own personal enjoyment. Fans cite the encouragement of these recordings as a key factor in their long-term loyalty to these bands.
Examples of bands who support this are Grateful Dead, Phish and Widespread Panic who are well known for allowing and encouraging their shows to be taped.
Bootlegs should not be confused with counterfeit or pirated recordings, which are merely unauthorised copies of music officially released by the record companies. Often every attempt is made to cause the belief that they are the genuine item, rather along the same lines as a counterfeited Rolex watch. However, as wrong as bootlegging is, some bootleggers are keen to stress that the markets for bootleg and counterfeit recordings are different, and a typical consumer for a bootleg will have bought most or all of that artist's official releases in any event.
Many bootleggers, are not motivated by a need to cheat the artist but rather the desire to collect as much material as possible concerning them. As mentioned, often they have all the officially released music but on top they have a vast library of bootlegs.
Many, if not most bootlegs consist of private or professional studio recordings distributed without the artist's knowledge or involvement. These could include demos, works-in-progress or even discarded material. They may even be made from private recordings not meant to be widely shared, or from master recordings stolen or copied from an artist's home, a recording studio or the offices of a record label. Very easy to do is copy from promotional material issued to music publishers or radio stations.
During the 1970s the bootleg industry in the United States expanded rapidly, made possible by the era of stadium or arena rock. Vast numbers of recordings were issued for profit by bootleg labels such as Kornyfone and Trade Mark of Quality. The large followings of artists such as Deep Purple, Jimi Hendrix, Bob Dylan, The Who, Led Zeppelin, The Grateful Dead, Black Sabbath, The Beatles, The Rolling Stones and Pink Floyd created a lucrative market for the mass production of unofficial recordings on vinyl, as it became evident that more and more fans were willing to purchase them. In addition, the huge crowds which turned up to these concerts made the effective policing of the audience for the presence of covert recording equipment virtually impossible.
The Berne Convention for the Protection of Literary and Artistic Works protects the copyrights on literary, scientific, and artistic works and has done since 1886. Article 9 of the Convention states that: Authors of literary and artistic works protected by this Convention shall have the exclusive right of authorizing the reproduction of these works, in any manner or form. [...] Any sound or visual recording shall be considered as a reproduction for the purposes of this Convention.
So, in the final analysis we can see that whilst popular, most bootlegging is in fact illegal. But it is understandable. The fan who picks up a cigarette packet discarded by a musician he follows, is not keeping the streets clean but simply adding to his collection of memorabillia.
Much of the music written by Tony Iommi and played by Sabbath has been pirated and copied. In the Far East its difficult to buy any recording which is original. Most are described as ROIO (recording of indeterminate origin).
However, when it comes to bootlegs, as mentioned previously, the desire to own any and everything linked to an artist or group so as to form part of a collection which is only and ever for personal use doesn't seem so bad.
It is unlikely that the practice will ever be stopped, so it is up to each and every person to examine their conscience and how this will reflect on the person or persons he or she claims to be a fan of.
